This Privacy Policy constitutes a part of PetRock’s terms of use. The terms used in this Privacy Policy shall have the same meanings as in the Terms and Conditions (T’s & C’s) except as otherwise provide herein. This Privacy Policy explains how Pet Rock collects, uses, processes, discloses, shares, transfers, and protects personal information obtained through Pet Rock. The terms “we,” “us,” and “our” refer to Pet Rock. When we ask for certain personal information from users, it is because we are required by applicable laws or government orders to collect such information or because it is relevant for our specified purposes and the provision of our services. Please carefully read the full content of this Privacy Policy. When visiting the Website or making use of any other Pet Rock Services and Platform(s), regardless of whether or not you register for a Pet Rock Account and/or apply to invest, you acknowledge, understand, and consent to all clauses described in this Privacy Policy. We will not use your personal information for any purpose not covered in this Privacy Policy or the T’S & Cs without prior notification to you and your consent. We will not share your personal information without your consent or for any other purpose not covered by this policy. The latest Privacy Policy has incorporated elements from the Protection of Personal Information Act 4 of 2013 (“POPI” or“POPIA”) as we act in accordance with its personal information processing rules within South Africa. Compliance with POPIA aligns us with European standards according to the provisions of the General Data Protection Regulation (GDPR).
2.1. “Account/ Pet Rock Account” means a User’s Pet Rock Account created on the Platform, including manual creation via email correspondence after acceptance of the Investor’s application, where any User investment will be held;
2.2. “Pet Rock” or “the Company” means both Pet Rock Digital Asset Management (Pty) Ltd, a private company duly incorporated in terms of the laws of the Republic of South Africa, with registration number 2021/667301/07, and Pet Rock Investments Limited, a company incorporated in terms of the laws of the British Virgin Islands with company number 2100363.
2.3. “Personal Information” means personal information as defined in POPI, including (but not limited to) information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person.
2.4. “Platform” means the Website, any email addresses associated to the Website, and/or any other platform associated with the provision of the Services by Pet Rock;
2.5. “Processing” means the processing of information as defined in POPIA.
2.6. “POPI or POPIA” means the Protection of Personal Information Act 4 of 2013 and regulations published in terms thereof.
2.7. “Services” means the cryptocurrency trading and investment service provided by Pet Rock as detailed in terms of the Terms and Conditions, including use of the website, Platform, and/or any other component of the Pet Rock network, including email communication.
2.8. “User Data” means data inputted by you, or by us on your behalf, for the purposes of using the Services or facilitating your use of the services, which may include your Personal Information. User Data may include, but is not limited to, your banking information, name, address, identity number and email address.
2.9. “Website” means www.petrockinvest.co.za or any other URL owned or controlled by Pet Rock that connects it to the public;
3.1. By creating a Pet Rock Account and/or using the Platform, including the submission of an application for investment, the use of any contact submission form, and any email correspondence with Pet Rock, you consent to our processing of your Personal Information and User Data as may be required for the provision of the Service, including but not limited to the manner described in the below clauses.
3.2. By using creating a Pet Rock Account, you agree to be bound by the provisions of the terms of use.
3.3. In administering the Services, we may store your Personal Information and User Data outside of your jurisdiction, which you hereby consent to. In so doing, we will take all reasonable steps to ensure your Personal Information and User Data is afforded the same security according to South African and European standards.
3.4. Should you wish to withdraw your consent, you may do so at any time by notifying us and deregistering for our services, and you may contact us at support@petrock.co.za . Please note that we may not be able to provide the Services should you withdraw your consent for our processing of your personal information and your Pet Rock Account may be deregistered from the Platform, or Pet Rock may otherwise take steps to close your investment account.
The followings are the types of information we may collect when you make use of the Services, particularly when registering for an Account and making use of the Platform:
4.1. Information You Provide to Us When Registering
4.1.1. When you apply to invest with Pet Rock and create a Pet Rock Account, you provide us with your
a) Your name and surname;
b) Your ID or Passport Number;
c) Your proof of address not older than 3 months;
d) Your bank account details for payment;
and other information which may be required by us to help identify you (“Identification Information”).
4.1.2. Should you create an Account on the Platform, you may also choose to add a phone number for SMS or Google Authenticator account for Two-Factor Authentication to improve account security.
4.1.3. If you agree to use biometric authentication methods to log into your Account, such as fingerprint recognition and facial recognition, you need to provide us with the corresponding information, such as the fingerprint information and facial information, and your consent to the processing of your biometric data.
4.2. Information We Collect to Comply with Regulatory Policies
4.2.1. To comply with global industry regulatory standards, local industry regulatory standards, and government orders in different aspects such as Anti-Money Laundering (AML), Know-Your-Client (KYC), and Counter-Terrorist Financing (CTF), Pet Rock is required to collect personal information in addition to Identification Information, such as identity documents (including passport, driver's license, national identity card, tax ID number, passport number, driver's license details, national identity card details, visa information, etc.), proof of address, source of funds declaration, purposes of fund documents, and source of wealth (“Regulation Information”).
4.2.2. We will explain to you the content and requirements of such personal information each time we collect the information and we reserve the right to change the content and requirements of the collected information as the global industry regulatory standards, local regulatory standards or government orders change.
4.2.3. This provision applies to both personal and institutional Pet Rock Accounts.
4.3. Information We Collect as You Access the Services
4.3.1. Service Usage Information
We may monitor and collect tracking information related to usage including but not limited to your phone number, access date and time, device type and device identification, operating system and hardware setting, browser type, and information derived from SIM card, network operator, IP address, GPS, base station and WLAN (“Service Usage Information”). This information may be directly obtained by Pet Rock or through third-party service providers. The collection of Service Usage Information helps our systems to ensure that our interface is accessible for users across all platforms and can aid during criminal investigations.
4.3.2. Transaction Information
In the case where the Platform facilitates the creation of User operated accounts, we may collect transaction information as you use the Services, including but not limited to deposit snapshots, account balances, trade history (such as transaction initiation, payment method, price, quantity, time, withdrawal and authorization information), order activity, and distribution history (“Transaction Information”). We collect such transaction information to monitor suspicious trading activity for user fraud protection, legal case resolution, and any other purposes disclosed in this Privacy Policy.
4.3.3. Communication Information
You agree that, for the purposes disclosed in this Privacy Policy, we are entitled to collect and use the information contained in or related to the communication that you send to us or generated through your use of the Services (“Communication Information”), which includes:
a) all messages, requests or other information you send in the course of your contact with Pet Rock;
b) all communications and file attachments in connection with your transactions with Pet Rock or other data generated primarily through your communications with us.
4.3.4. Financial Information
You agree that, for the purposes disclosed in this Privacy Policy and for the provision of the Services to you, we may collect and use the information contained in or related to your financial information when you use the Services, including without limitation, bank account information, payment card primary account number (PAN), transaction history, trading data, and/or tax identification. We collect such financial information to monitor suspicious financial activity for user fraud protection, legal case resolution, to provide the Services and for any other purposes disclosed in this Privacy Policy.
5.1. Information Pet Rock Automatically Collects
Most of the personal information that we collect is directly provided by you. In the following situations, we will collect and process the information about you:
a) where you register for or log in to your Pet Rock Account, if applicable, or visit the Website, or use Pet Rock Services;
b) where you voluntarily complete any user survey or provide feedback to us via email or any other channel;
c) where you use cookies of the browser or software in visiting or using our Website or apps;
d) other situations where we may automatically collect your information as mentioned in this Privacy Policy or our T’S & C’S.
5.2. Information Collected from the Third-party Sources
We may collect information about you from third-party sources, including but not limited to, the following channels:
a) public databases, credit bureaus and ID verification partners;
b) blockchain data;
c) marketing partners and resellers;
d) advertising partners and analytics providers.
5.3. Anonymized and Aggregated Data
Anonymization is a data processing technique that removes or modifies personal information so that it cannot be associated with a specific individual – the data is ‘de-identified’ from the individual it belongs to. We may use anonymized or aggregate customer data for any business purpose, including to better understand Users’ needs and behaviours, improve our products and services, conduct business intelligence and marketing, and detect security threats. We may perform our own analytics on anonymized data or enable analytics provided by third parties.
We use the information we collect about you for the following purposes or in the following ways:
6.1. To Provide and Maintain Pet Rock Services
We use the information collected to deliver, maintain and provide better Pet Rock Services (including but not limited to processing transactions) and verify Users’ identities.
We use the IP address and unique identifiers stored in your device’s cookies to help us authenticate your identity and activities on the Website and provide the Service. Given our legal obligations and system requirements, we cannot provide you with all or some of Pet Rock Services without data like Identification Information, Service Usage Information, Communication Information, and Transaction Information.
We may disclose your information to third-party service providers for the purpose of the improvement and provision of the Services. This may include third-party contractors, cloud computing infrastructure providers, analytical, Know Your Customer and cyber security service providers.
6.2. To Protect Our Users
We use the information collected to protect our platforms, Users’ Accounts (where applicable), and archives.
We use IP addresses and cookies to protect against automated abuse such as spam, phishing, and Distributed Denial of Service (DDoS) attacks.
We analyse trading activities with the goal of detecting suspicious behaviours as early as possible to prevent potential fraud and loss of funds to bad actors.
6.3. To Comply with Legal and Regulatory Requirements
With respect to the privacy and security of personal information, we may disclose your personal information in compliance with our legal obligations, government requests, and reasonable user-generated inquiries. Except for the situations stated in this Privacy Policy or the T’S & C’S, we will not disclose or provide any of your personal information to third parties without obtaining prior consent from the User.
6.4. For Measurement, Research and Development Purposes
We may analyse statistical trends in your use of the Services to improve the operation of the Services. Any personal information analysed in this manner will be anonymised. We continuously monitor activity information within our systems and our communications with users to look for and quickly fix problems.
6.5. To Communicate with You
We use personal information collected, including your phone number or email address to interact with you directly when providing customer support or to keep you informed on logins, transactions, account security and other aspects. All direct communications are properly kept at Pet Rock or the service provider designated by Pet Rock, to be reviewed for accuracy, retained for legal purposes, or to be used to perform other statutory or contractual obligations.
6.6. To Enforce Our T’S & C’S and Other Agreements
6.6.1. The collected information may be used to enforce our T’s & C’s, and other agreements, with our Users.
6.6.2. This includes, but is not limited to, reviewing, investigating, and preventing any potentially prohibited or illegal activities that may violate the foregoing provisions, or disclose the relevant information to a third party in accordance with Pet Rock’s legal obligations.
6.6.3. Pet Rock reserves the right to suspend or terminate the Account of any User found to be engaged in activities that violate our T’S & C’S and other agreements with our Users.
6.7. For Marketing and Advertising
We may share anonymised personal information with our marketing partners for the purposes of targeting, modelling, and/or analytics as well as marketing and advertising. We will not disclose your personal information or user data to third parties for the purposes of direct marketing.
6.8. Other Purposes
We may disclose your personal information for other purposes from time to time, which purposes we will obtain your explicit consent for and for which we will provide full details.
We endeavour to keep our users up to date on the latest Pet Rock Products and Services. We provide all our users with the option to unsubscribe from any marketing or promotional material by clicking the unsubscribe link at the bottom of our marketing communications.
Pet Rock keeps personal information safe using secured storage with industry standard encryption and has implemented a number of security measures to ensure that your information is not lost, abused, or altered, including, but not limited to:
8.1. Physical Measures
Materials containing your personal information will be stored in a locked place.
8.2. Electronic Measures
Computer data containing your personal information will be stored in the computer systems and storage media that are subject to strict log-in restrictions.
8.3. Management Measures
Only authorized employees are permitted to access your personal information for the purposes described in this Privacy Policy. Such employees must comply with our internal confidentiality rules for personal data. We have also imposed strict physical access controls to buildings and files.
8.4. Technical Measures
Encryption technology such as Transport Layer Security (TLS) may be used to transmit and store your personal information. We use various currently available general security technologies and supporting management systems to minimize the risks that your information may be disclosed, damaged, misused, accessed without authorization, disclosed without authorization, or altered.
8.5. Other Measures
Our web server is protected by the “firewall”.
9.1. While we will take all reasonable steps to ensure the security of your User Data and Personal Information according to industry standards, it is not possible to guarantee the complete security of all information provided at all times.
9.2. We will notify you as soon as reasonably practicable of any breach of security, loss of or damage to your User Data or Personal Information.
9.3. Users are responsible for taking reasonable precautions to safeguard their Personal Information.
9.4. Although we endeavour to ensure your information is as correct as possible, you are responsible for notifying us of any changes to your User Data or Personal Information as reflected on your customer profile or statements in respect of the Service.
9.5. Pet Rock will not be held liable for any losses of any nature which are due to incorrect User Data or Personal Information provided by users in respect of the Service.
9.6 Pet Rock will not be held liable for any loss or damage arising from a security breach or disclosure of your Personal Information or User Data, to the maximum extent permitted by law.
9.7. Pet Rock shall not be liable for any damage or interruptions caused by any computer viruses or other malicious code that may affect your computer or other equipment, or any phishing, spoofing or other attack. Pet Rock advises the regular use of a reputable and readily available virus screening and prevention software. You should also be aware that SMS and email services are vulnerable to spoofing and phishing attacks and should use care in reviewing messages purporting to originate from Pet Rock. Pet Rock will not be held liable should you disclose any of your personal information or your information relating to the Services to a third-party.
9.8. You will notify Pet Rock immediately at support@petrockinvest.co.za if you are aware of any unauthorised use of your Pet Rock Account or your email address by any person or any other violations to the security of the Website.
9.9. We will notify you as soon as reasonably practicable of any breach of security, loss of or damage to your User Data or Personal Information.
9.10. If you suspect that your personal information has been compromised, especially account and/or password information, please lock your Pet Rock Account and immediately contact Pet Rock Customer Support team at support@petrockinvest.co.za
Unless otherwise stipulated by law or the T’S & C’S, we will retain your records for a period of five years after closure of your Pet Rock Account. After this period, we will destroy or anonymise your personal information and may retain it for statistical purposes.
We may transfer your personal information to other countries or regions than South Africa or the European Union, which you consent to, for storage or analytical purposes and may enlist the services of third-party operators to provide storage services. Any regions where we store your data will be subject to the same standards as prescribed by POPI, in their local jurisdictions. Any third-party operators will treat your User Data and Personal Information as confidential and will be bound by substantially the same industry security standards as we are.

Cookies are small amounts of data that are sent to your browser and stored on your computer’s hard drive to collect standard internet log information and visitor behaviour information. When you visit Pet Rock, we can automatically collect information from you through cookies or similar technologies
How Do We Use Cookies?

13.4 Right against Direct Marketing
You have the right, under certain circumstances, to not be subject to direct marketing.

Under certain circumstances as required by law you have the right to object to the processing of your personal information; however, you understand that such objection of the processing may prevent your Pet Rock Account from being verified and prevent us from providing you with some the Service. If you are unsatisfied with the resolution of any objection, you may consult the Information Regulator of South Africa at complaints.IR@justice.gov.za or the relevant authority of your jurisdiction.
14.1 Privacy Policies of Other Websites
If you visit other third-party platforms or partner’s websites, apps via the links on Pet Rock, you should agree with and abide by their separate and independent privacy policies. We are not responsible for the content or the activities therein.
14.2 Privacy Policies of Pet Rock
This Privacy Policy applies to all platforms, websites, and departments of the Website and Pet Rock ecosystem.
From time to time, Pet Rock may revise this Privacy Policy to reflect changes in Law or our personal-data collection, processing, and use practices. Changes to this Privacy Policy will be announced by posting on the Website and/or by direct notification to users. Should you not agree with the revised content of any updated Privacy Policy, you may exercise the option to de-register for Pet Rock services. When an updated version of the Privacy Policy is released, your continued access to Pet Rock means that you agree to the updated content and agree to abide by the updated Privacy Policy.
